Terms of Service for 321Fixed

1. Service Provider
   321Fixed is operated and developed by UPHILL MEDIA SOLUTIONS SRL, a limited company based in Romania (hereinafter referred to as “we,” “us,” or “our”). UPHILL MEDIA SOLUTIONS SRL is dedicated to enhancing civic engagement through innovative technology solutions.
   
2. Acceptance of Terms
   By accessing or using the 321Fixed application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you disagree with any part of the terms, you may not access the App.
   
3. Description of Service
   321Fixed is a civic engagement platform that allows citizens to report local issues to their municipal authorities.
   
4. User Accounts
   4.1. You must create an account to use certain features of the App.
   4.2. You are responsible for maintaining the confidentiality of your account and password.
   4.3. You agree to accept responsibility for all activities that occur under your account.
   
5. User Content
   5.1. You retain all rights to any content you submit, post or display on or through the App.
   5.2. By submitting content, you grant UPHILL MEDIA SOLUTIONS SRL a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content in connection with the service.
   
6. Prohibited Uses
   You may not use the App for any illegal or unauthorized purpose, including but not limited to violating any local, state, national, or international law.
   
7. Intellectual Property
   The App and its original content, features, and functionality are owned by UPHILL MEDIA SOLUTIONS SRL and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
   
8. Termination
   We may terminate or suspend your account and bar access to the App immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
   
9. Limitation of Liability
   In no event shall UPHILL MEDIA SOLUTIONS SRL, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
   
10. Changes
    We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes to these Terms.
    
11. Account Deletion
    11.1. You have the right to request the deletion of your account and personal data.
    11.2. To initiate this process, navigate to Account > Settings within the App and select the option to delete your account. You can also request deletion of your account via email to app@321fixed.com.
    11.3. Upon receiving your request, we will delete your account and personal data within 30 days, except where we are required to retain information for legal or regulatory purposes.
    
12. GDPR Compliance
    As a company based in the European Union, UPHILL MEDIA SOLUTIONS SRL is committed to compliance with the General Data Protection Regulation (GDPR).
    12.1. Data Collection and Use: We collect and process personal data only for specific, explicit, and legitimate purposes as outlined in our Privacy Policy.
    12.2. Data Subject Rights: You have the right to access, rectify, erase, restrict processing, object to processing, and data portability of your personal data.
    12.3. Data Protection Officer: For any GDPR-related inquiries, you can contact our Data Protection Officer at app@321fixed.com.
    12.4. Data Breaches: In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify you and the relevant supervisory authority without undue delay.
    
13. Governing Law
    These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.
